Rationale for use in Muhammad al-Durrah incident[sunting | sunting sumber]
Although this image is subject to copyright, its use is covered by U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:
- It is an important image, offering a different perspective from the mainstream view of what occurred.
- It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value, as it was this image in particular that was presented to the Paris Court of Appeal.
- The imagery represents a key part of the story and the article would be significantly poorer without it.
- We have no reason to believe the copyright holder would object.
- It has no monetary value that would be affected by our use of it.
- A French ballistics expert commissioned by Philippe Karsenty presented this diagram to the Paris Court of Appeal in 2008. It included a position called the "pita", in which several sources say Palestinian police officers stood, armed with automatic rifles.[1] This position did not appear on the France 2 cameraman's diagram, which marks that area as "Fields". This is a crucial point. It's therefore important to show both diagrams side by side.
